On those off the cuff thoughts then no. Rape is rape, and the situations should have no bearing.
If there is more violence then more compo, but not a reduced compo for the act of having sex with someone without their consent simply because of the circumstance.
to answer you.. i know of 2 people here in dundee.
Miss A was raped,a hauled into a park kinda rape. she was under 16 and HAD been drinking, but was NOT drunk. her tarrif was reduced as she was seen to have ” contributed” to it by having a drink.Yes there are tarrifs on these things, but in the case of rape ,they dont seem to take into account the psychological “injuries”. the normal amount is 12 grand. Miss A received just over 8.
now meet mr B… a well known abuser of women/girls , never been reported through fear of what he might do. a weel known fighter and police grass. one of his “victims” met up with him one night and glassed him when he tried to manhandle her. he was awarded 18 grand ! as he played on the distress etc. and how the small scar on his cheek would affect him forever blah de blah. ( more like a badge of honour to prove his badness)
There are no tribunals to hear those claims. just have a form to go on,it seems the more souped up and exagerrated the claims are,the better the chance.Pete why bother reading this thread if is annoys you so ?
