Not so black and white now eh

Cas makes an extremely good point here – no the story wasn’t as ‘black & white’ as it first appeared….. indeed quite the opposite.

I was the executor of a friend’s estate a while ago and he left a chunk of the estate to a ‘charity’. (It was the residual portion after all his other bequests etc had been dealt with).

My experience was that the charity was a seriously money grubbing organisation – absolutely every penny had to be accounted for in case they didn’t get all they could out of the estate. they pushed and pushed for assets to be liquidated rapidly seemingly regardless of gaining maximum value….. they just wanted their paws on the cash ASAP.

I now realise that charities do pretty well out of wills and suchlike and have entire departments set up to maximise their incomes from this area ….. which I might add is substantial.

Hasn’t someone tried to get Ickworth House in Suffolk back from the National Trust because he claims his uncle, who owned it, was an alcoholic and was habitually drunk during the period when he made his will leaving the place to the NT?

In the case of this woman, the strange circumstances of the will make me feel that she was right to contest the will and deserves to get the inheritance.

so as the title says , whats the point in making a will, and if these ppl arent right in the head when they are made , shud money be accepted by lawyers ?shudnt ppl,s state of mind be looked into at the time , the same lawyers are accepting hard cash for them makin a will and then accepting hard cash again on it being contested , and saying ” they where,nt of sound mind when it was made ” yet took the cash. in the previous post u talk of her getting her inheritance , wasnt hers tho was it , wasnt left to her

That, tictax, is the joy & delight of being a Wills and Probate lawyer. You can charge your client a nice juicy fee for preparing their Will, in the certain knowledge that they can never complain or sue you if your work later (after their demise) turns out to be defective.

Neither of my parents have wills and refuse point blank to discuss the matter… they’re both in their 80’s, I have 3 siblings and know for a fact that my sister will turn up with a Pickfords van the day they go off to pastures green. Good Luck to her when i’ve had conversations with my mother about possessions etc I just say ” mum, sell them and enjoy it now”. I would never squabble over what they leave when they go and fingers crossed they live til their 100.

Mr Velvet and I made wills years ago when the children were little as a friends of mine died in a car accident and their was a dreadful custody case by both sets of grandparents. Now my children are older they can have whatever I leave behind and share it equally ( a few buttons and a bit of fluff last time I looked)
